What PROGA Changed — and Why It Won’t Reverse Quickly

The Promotion and Regulation of Online Gaming Act, 2025 (PROGA) was passed by Parliament on 21 August 2025, received Presidential assent on 22 August 2025, and was operationalised on 1 May 2026 through Gazette notifications issued by the Ministry of Electronics and Information Technology (MeitY) dated 22 April 2026. The accompanying Promotion and Regulation of Online Gaming Rules, 2026 came into force on the same date.

These dates are fixed and won’t change. Three structural elements of the Act are also fixed:

1.     All online money games are prohibited. PROGA does not distinguish between games of skill and games of chance. Any online game where a player pays a stake or fee in expectation of monetary return falls under the prohibition. There is no licence, no tolerance window and no skill-based exception.

2.     Criminal penalties apply across the value chain. Operators face up to three years in jail and fines up to ₹1 Crore for offering or facilitating online money games. Advertising carries up to two years in jail and ₹50 lakh fines. Bank executives processing prohibited transactions can be held personally liable.

3.     The Online Gaming Authority of India (OGAI) is the central regulator. Constituted as an attached office of MeitY, OGAI classifies games, registers permitted formats (e-sports and social games) and enforces compliance with civil penalties of up to ₹2 Crore.

Constitutional challenges to PROGA were filed with the Supreme Court in late 2025. The court referred them to a three-judge bench, with hearings beginning 21 January 2026. A separate Supreme Court judgment in mid-2026 confirmed that individual states retain authority to regulate online gaming alongside PROGA — which actually adds a layer of restriction rather than relaxing it. Until and unless these proceedings produce a substantive ruling that carves out poker, the position holds: real-money online poker is not legally offered in India.

What This Means for Spartan Poker
